Terms of Service and Privacy Policy Agreement
Article I. Agreement to Terms
Our Website’s Terms of Service and Privacy Policy (hereinafter “Agreement”) constitute a legally binding contract between each visitor (hereinafter “User”) and Kalla Foundation, Inc. (hereinafter “Foundation,” “we,” “us,” or “our”), governing access to and use of the website located at https://kallafdn.org (hereinafter “Website”). By accessing or using this Website, User agrees to be bound by all terms and conditions contained herein, and to comply with all applicable laws and regulations. If User does not agree to these terms, User must discontinue use of the Website immediately.
Article II. Intellectual Property and License
All content published on the Website is licensed under the Creative Commons Attribution 4.0 International License, unless otherwise indicated. Users are permitted to copy, redistribute, remix, transform, and build upon the material, including for commercial purposes, subject to the following conditions:
Proper attribution must be given to the Foundation and any additional rights holders.
A link to the applicable license and an indication of any modifications must be provided.
No additional legal or technological restrictions may be imposed on the use of the material.
Content containing third-party materials or otherwise noted exceptions may not be included under this license; such materials are used with permission from their owners or holders.

User agrees not to:

The Foundation reserves the right to remove content or deny service at its sole discretion in the event of any violation.
Article IV. User Content
Users who submit comments, media, testimonials, or other material grant the Foundation the non-exclusive right to use, reproduce, modify, and publish that material on the Website and in associated promotional communications, under our Creative Commons Attribution 4.0 International License terms. User submissions must not violate any law or the rights of any third party. The Foundation is not liable for content submitted by Users but reserves authority to remove any material judged inappropriate or infringing.

The Foundation is committed to protecting the privacy of Website Users. This Privacy Policy outlines our data collection and usage practices:
Data Collection
We collect information voluntarily provided by Users, such as names, email addresses, contact information, and feedback through donation forms, event registration, or mailing list subscriptions.
Squarespace, our web host, may also collect non-personal data (such as IP addresses, browser types, referring URLs, and pages viewed) through analytics and site management tools as part of its hosting services.
Data Usage
Personal information is used exclusively for purposes consistent with the Foundation’s charitable mission, such as communicating with volunteers, processing donations, or responding to inquiries. The Website and Foundation activities are not directed at children under the age of 13. We do not knowingly collect or retain personal information from children under this age.

Article VI. Limitation of Liability and Disclaimer

User agrees to indemnify, defend, and hold harmless the Foundation, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising out of User’s violation of these Terms or misuse of the Website.

The Foundation reserves the right to change, amend, or update this Agreement at any time, without prior notice. Continued use of the Website following modifications constitutes User’s acceptance of the revised terms. Material changes will be posted to this page, with last updated date indicated.
Article IX. Governing Law
These Terms of Service and Privacy Policy shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of law provisions.
